1. Acceptance of Terms

By accessing and using the services provided by RAHI by IBIZZ TECHNOLOGIES ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

RAHI by IBIZZ TECHNOLOGIES provides IT consulting, software development, mobile app development, cloud solutions, database management, cybersecurity services, and related technology services. Our services are subject to availability and may be modified or discontinued at our discretion.

3. User Responsibilities

3.1 Accurate Information

You agree to provide accurate, current, and complete information when using our services or contacting us. You are responsible for maintaining the confidentiality of any account information.

3.2 Prohibited Uses

You may not use our services for any unlawful purpose or to solicit others to perform unlawful acts. You agree not to:

• Violate any laws or regulations
• Infringe upon the rights of others
• Transmit any harmful or malicious code
• Attempt to gain unauthorized access to our systems
• Use our services for any commercial purpose without permission

4. Service Terms

4.1 Project Scope

All projects will be defined by a detailed scope of work document that outlines deliverables, timelines, and costs. Any changes to the scope must be agreed upon in writing by both parties.

4.2 Payment Terms

Payment terms will be specified in individual project agreements. Generally, we require:

• 50% advance payment before project commencement
• 40% payment upon completion of major milestones
• 10% final payment upon project delivery and acceptance

4.3 Timeline

Project timelines are estimates and may be affected by factors beyond our control, including client feedback delays, scope changes, and technical complexities.

5. Intellectual Property Rights

5.1 Client Ownership

Upon full payment, the client will own all custom-developed code, designs, and deliverables created specifically for their project, excluding any pre-existing intellectual property owned by RAHI by IBIZZ TECHNOLOGIES.

5.2 Company Rights

We retain rights to our methodologies, frameworks, and any pre-existing intellectual property used in the project. We may use project learnings to improve our services, provided no confidential client information is disclosed.

6. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary and confidential information disclosed during the course of our business relationship. This obligation survives the termination of our agreement.

7. Limitation of Liability

To the maximum extent permitted by law, RAHI by IBIZZ TECHNOLOGIES shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from the use of our services.

8. Warranty and Support

8.1 Warranty Period

We provide a 90-day warranty on all custom-developed software and applications, covering defects in workmanship and functionality as specified in the project requirements.

8.2 Support Services

Post-delivery support and maintenance services are available at additional cost and will be provided under separate service agreements.

9. Termination

Either party may terminate this agreement with 30 days written notice. In case of termination:

• Client will pay for all work completed up to the termination date
• We will deliver all completed work to the client
• Confidentiality obligations will continue to apply

10. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or government actions.

11. Dispute Resolution

Any disputes arising from this agreement shall be resolved through good faith negotiations. If negotiations fail, disputes will be subject to the jurisdiction of the courts in Jaipur, Rajasthan, India.

12. Governing Law

This agreement shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

13. Severability

If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

14. Entire Agreement

This agreement, together with any project-specific agreements, constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements.

15. Amendments

We reserve the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the modified terms.
